| | A doctor who revived a baby born without a heartbeat and who now suffers from severe disabilities cannot be held liable for malpractice, the Washington Supreme Court has ruled. The child’s parents argued that the doctor should have sought consent before attempting to resuscitate the child for more than half an hour. The justice reasoned that saving a life is the preferable outcome, even if it means disability for the patient. Curt Woodward, Seattle Post-Intelligencer 11/08/2007 | |
| | A lawsuit that accuses the University of Colorado of turning a blind eye to sexual misconduct by football players and recruits can move to trial, an appellate court ruled Friday. The lawsuit was filed by two former university students who claim they were assaulted by players visiting the campus on a recruiting trip. In its decision, the appellate panel rejected the university’s request to reverse an earlier decision that reinstated the lawsuit and to have the matter heard before the entire appellate court. | | The wife of an executed Texas inmate has withdrawn her lawsuit against an appeals court judge who refused to keep the court open past 5 p.m. to hear a last minute appeal. The reasoning behind the withdrawal of the lawsuit is unclear. The lawsuit sought unspecified damages and a court order to prevent court personnel from stopping emergency death penalty appeals from being filed. AP, Houston Chronicle 11/12/2007 | |
| | A negligence lawsuit, filed by a farm worker whose leg was run over by a tractor, has been reinstated by the South Dakota Supreme Court. The lawsuit alleges that Van Eye Farms was negligent in the accident for failing to properly train and supervise employees and for failing to provide a safe workplace. In its ruling, the high court said that there was sufficient evidence to question whether the farm breached its duty to provide reasonably safe working conditions for its employees. | | A jury has ordered Goodyear to pay $4.4 million to a Seattle woman who claimed that she was harassed and ultimately fired because of her sexual orientation. According to the lawsuit, Melissa Sheffield was demoted after complaining about improper conduct by a coworker and later was wrongly terminated after suffering an on-the-job injury. Jurors found that Goodyear had retaliated against Sheffield and failed to make accommodations for her disability. Christine Clarridge, Seattle Times 11/10/2007 | |
| | Minnesota lawmakers met Friday to consider whether to offer financial assistance to victims of August’s bridge collapse. Some lawmakers argued that the state could set a dangerous precedent by placing a price on human life and suffering. In the absence of a fund, those injured in the disaster would be forced to seek damages through the courts. Martiga Lohn, Forbes 11/09/2007 | |
| | Former federal judge Michael B. Mukasey was sworn in as the 81st attorney general Friday at a private ceremony at the Justice Department. Mukasey’s confirmation followed a tight Senate vote of 53 to 40. Mukasey was preceded as attorney general by Alberto Gonzales who resigned the position in August.
