The law firm that represented investors in a $7.3 billion settlement with Enron is seeking $688 million for their work in negotiating the deal. The law firm of Coughlin, Stoia Geller, Rudman & Robbins based their request on a percentage of all settlements reached since shortly after the company’s 2001 collapse. Kansas jury has ruled not to hold BP North America liable for the cleanup of an oil refinery located in the small town of Neodesha. The town had filed the lawsuit against the oil giant in hopes of recovering $423 million for damages caused by oil spills, breach of contract and fraud. Countrywide Financial Corporation has admitted that it fabricated documents supposedly sent to a homeowner involved in a bankruptcy case inPennsylvania. According to court documents, Countrywide recreated three letters that claimed the borrower owed the company almost $5,000 for escrow deduction discrepancies. Countrywide maintains that it is not their policy to recreate documents for purposes of evidence and the future discovery will show that the borrower had received the documents.  Gretchen Morgenson, The New York Times  01/08/2008

A couple in New York who claimed their house was severely damaged by vibrations from an Air France Concorde jet will receive $995,000 from Allstate Insurance Co. as part of a settlement with the insurer. Jurors initially awarded the couple $1.15 million in damages to their 12-room concrete and steel house but Allstate appealed the award maintaining that poor construction and maintenance were to blame for the damage.  APUSA Today  01/07/2008

A lawsuit was filed Friday that accuses Sears, Roebuck & Co. of violating portions of the Illinois Consumer Fraud Act. According to the complaint, the Web site managemyhome.com compromises customer information and exposes customers to fraud. Baltimore’s mayor and city council have filed a lawsuit against Wells Fargo Bank alleging that the lender lured African-Americans into high-interest mortgages more often than other groups. The lawsuit, filed today in district court, says that the practice, known as reverse lending, violated federal housing law. Baltimore’s lawsuit comes as a number of cities are looking for ways to recoup expenses associated with buildings left vacant following foreclosure.  John Fritze, Baltimore Sun  01/08/2008

New Jersey lawmakers have passed legislation that will give families involved in wrongful death litigation the right to recover damages for emotional harm. The bill was passed early this morning by a 41-32 vote following heated debate by legislators. The city of StamfordConn. and a contractor have agreed to pay $500,000 to settle a lawsuit filed by the mother of child who was burned while visiting a city park. The 5-year-old girl suffered serious burns in 2004 when her dress caught fire on a spotlight in Jackie Robinson Park. STUDY
 
A new study casts doubt on a supposed link between autism and a mercury-based preservative once found in many childhood vaccines. According to researchers from the California Public Health Department the childhood autism rate continued to climb even after the preservative thimersosal was removed from virtually all vaccines in 2001. Doctors have continually argued that a link between thimersosal and the neurological disorder does not exist.  AP, TheNew York Times  01/08/2008
