Special federal law entitled Federal Employer’s Liability Act. Employees of the railroad are protected by law that is more liberal than local state law regarding injury or death. If the railroad’s negligence is at fault at all in the injury then it is liable for damages. This law was first created in the early years of the industrial revolution when many railroaders were killed or maimed with no hope of compensation for them or their families. The unusually dangerous nature of railroad work has been offset by this law providing financial security for the workers.
